All are illegal and a federal crime. Penalties include fines of up to $250,000 and jail terms up to five years. Also keep in mind the NET The no electronic theft act of December 1997. Basically there are 5 basic forms of piracy 1. END USER COPYING or (softlifting) sharing of software friends, workplace, etc. 2. HARD DISK LOADING Computer dealers load unauthorized copies of software onto the hard disk of the pc. 3. COUNTERFEITING software is illegal duplication and sale of copyrighted software in a form designed to make it appear to be legitimate. 4. INTERNET Piracy occurs when copyrighted software is downloaded to users connected to the internet without the express permission of the copyright owner. 5. LICENSE MISUSE this is broken down into 5 categories a. academic product misuse. This is product manufactured, licensed for educational purposes but is going to the public domain. NFR not for resale product misuse not for normal commercial distribution OEM standalone product- version software has been unbundled from it designated computer system and distributed as a separate product. WWF (MEF) World wide fulfillment a.k.a. MS Easy fulfillment for select or open license. They have stickers on the shrink-wrap of the CD case that identifies the products as"Microsoft Easy Fulfillment" or "World Wide Fulfillment" And last Volume licensing (a select-provides savings for medium and large organizations with significant volume requirements through forecasting software needs over a two-year period. B) Open- provides savings for small and medium organizations for licenses of as few as 20 units of particular software products, with a simple ordering process.

1. Academic- take the ir against the company/individual that distributed, or is advertising the prouduct. then advise the informant not to purchase the product/if purchased return for refund. Educate the informant with details regarding FPP distribution standards and security features/request documentation or url for target. have them fax to your attention. 2.Compilation CD take a i/r on indiviudal or target. Advise the informant not to purchase locate a reseller that has proper version/educate/rqst docs or url/have them fax the info to you 3. Corporate Copying -complete the i/r report, and take down as much as possible, educate the informant, transfer to bsa you must mark sent to bsa in the action items in the database. Also capture the name fo the person you are transferring the call to the bsa and record this in the comments section within the action items. 4. Counterfeit Take the i/r then you need to decide if the product is to appear as genuine product of our company, ask the the informant to send it to us. All items received with the product, the invoice/receipt, full target info,informant info, takes 7-10 business days, provide the informant the ir number . Educate the informant with details regarding fpp distribution standards and security features provide them the proper address either east west or central. 5- Hard Disk Loading This is when they are missing the 5 most important items the media, the manual, the EULA the COA and registration. Take the i/r advise the caller they need to get any missing items from the system builder, or to return the product for a refund, and then locate a reseller that will provide them with a proper product. Educate caller/ rqst a copy of their invoice or receipt. Have them fax this info to your attention/when you receive this fax forward this via email to the paralegal for the region in which the target resides. the e-mail must containt the ir# and target name in the subject line. Once you forward the fax to the Paralegal, you must mark "sent invoice/docs to channel team" ;in which the action items in the database.6- Individual copying take the i/r complete and educate the informant on licensing policy if necessary. 7. Internet Take an i/r against the company/individual that distributed/or is advertising the product. Advise the informant not to purchase the product. If they have already purchased it have them return the product for a refund, and then locate a reseller that will provide them with the proper version of Full Package Product. Educate the informant with the details rqst documentation on the url/fax to your attention 8. NOT FOR RESALE take an i/r on company or person. Advise not to purchase/or get refund educate caller on fpp distribution and security features request documentation or the website in which the product is being offered. have them fax you. 9.
